Any insertion request from the advertiser or the advertising agency implies the latter’s acceptance of and compliance with the following general conditions and with our advertising rates.
The Farriers Journal (DIASSE Sprl) reserves the right, at any time, to cancel or refuse any insertion request without compensation or recourse. In the case of cancellation, only those insertions having already been published will be owing, and these at the subscribed rate.
Date of insertion and position
The agreed dates and requested positions for insertions are not guaranteed. However, the advertiser’s wishes will be taken into consideration as far as possible. «Reserved» positions : reservations will be made in the order in which they are received. In the instance of full subscription or of technical impossibility, alternative proposals will be made to the advertisers.
Material
Material that the customer provides for his advert are accepted at the latter’s own risk. The Farriers Journal may in no way be held responsible with respect to any material that has not been claimed. All modification made by The Farriers Journal on the customer’s request will be invoiced.
The exact composition of tints to be reproduced, the consistency of inks and the exactitude and uniformity of paper tints are not guaranteed. Author’s corrections leading to modifications (additions or deletions) will be charged to the customer’s account. Submission of documents ready for printing will be made at the latest by the first day of the magazine’s month of publication.
Any modification to the instructions given or any cancellation is only valid when submitted in writting and must be received in our offices at least 21 days before publication.
Since they are considered to act in the capacity of author, all advertisers commit themselves to assume full responsibility with respect to The Farriers Journal for the publication of their advertisements. Therefore all advertisers agree to discharge and compensate The Farriers Journal as necessary in any instance of any claims, damage or judicial obligations that The Farriers Journal may be obliged to answer following the insertion of an advertisement. The advertisers agrees, in particular to pay The Farriers Journal the cost of inserting a legal right to reply that has be published in the magazine.
The advertiser exonerates us from any responsibility for the consequences of any fault whatsoever commited in executing his advertisement, except in the event of serious negligence on our part. We thus decline all responsibility for printing faults caused by poor quality material or documents submitted by the advertiser, and for damage to this material. Furthermore, The Farriers Journal declines all responsibility with respect to any errors should the text be dubious, incomplete, badly written or badly edited in any way or if they have been transmitted by telephone or translated as without charge by ours services.
Any compensation that we may, in spite of this, be led to pay to our customers due to contractual responsibility, shall not exceed the price paid by the advertiser for the incriminating insertion.
Any event beyond our control, even if it is foreseenable or envisaged and independent of our will, that prevents, delays or reduces the issue or the publication, legitimately suspends the execution of the orders and entirely discharges us of all responsibility for compensation.
- Unless specifically agreed otherwise in writing, advertisements or announcements in The Farriers Journal are payable eight days after the invoice is sent.
- All fiscal taxes applicable to the advertisement are payable by the advertiser.
- A commission of 15% is accorded to advertising recognized agencies providing they comply with The Farriers Journal’s technical requirements and that they pay in full within thirty days of the invoice date.
- The advertiser’s agencies and other agents all undertake individually to pay our invoices.
- Non-payment of an invoice by the date on which it is due, causes the debtor to pay interest at an annual rate of 18% legitimately and without formal notice. Furthemore a contract lump sum penalty of 15% will be applied to the invoice with a minimum of 100 euros.
- Debt collection costs (bank charges) are chargeable to the customer.
All claims must be submitted in writing within 8 days of the publication date, or be forfeited, and in no way does this suspend, delay or cancel liability for payment of the advertisement.
A discount is given in accordance with the conditions shown in the price list depending on the net account value, excluding VAT, of commercial advertisements per calendar year (personal and commercial small ads excluded). This discount is allowed at the time of invoicing following each publication. To be eligible for this discount, the advertiser or the customer is required to regularly pay his invoices within the allowed time. For advertisers that have used the services of several advertising agencies, the sales discount will only be obtained for each partial sales value that is attributable to each of the agencies.
A justifying copy is sent to the advertiser for each published advertisement (excluding small ads).
The Farriers Journal reserves the right to modify the advertising rates at any time. The new rates will be applied without distinction to all orders. Advertisers that have a contract in progress will only have the right to terminate it if they do not accept the new rates : this termination must be notified in writing, at least 15 days before being valid.
Any litigation or dispute caused by application of these general terms and conditions will exclusively be arbitrated by the Nivelles law court (Belgium) even in the case of incidental requests or of warranty appeal.
